My practice covers a range of areas with a particular emphasis on commercial litigation, professional indemnity litigation, liquidation related matters, regulatory matters as well as disciplinary proceedings.

I have experience in advising and acting for high profile international clients in relation to professional negligence claims, cross-border insolvencies, fraud investigations (including asset tracing and recovery), general contractual disputes, employment matters and administrative law issues. I also have experience in contentious probate cases and estate administration cases.

Since 2018, I has acted as both defence and indemnity panel solicitors under the Hong Kong Solicitors Professional Indemnity Scheme in various professional negligence claims.

Being proficient in English, Mandarin and Cantonese, I understand the needs of international clients with different backgrounds and I am confident in delivering practical and efficient legal services to clients with my legal knowledge, experience and skills.

Regulatory Matters

  • Advising a number of major regulators in Hong Kong such as The Stock Exchange of Hong Kong, The Accounting and Financial Reporting Council, The Hong Kong Institute of Certified Public Accountants and the Competition Commission on the discharge of their public law functions
  • Advising on disciplinary proceedings and appeals brought under the disciplinary regimes of different regulators, as well as related judicial review proceedings
  • Advising on a major regulator in Hong Kong in designing and formulating their internal investigative and disciplinary policies and procedures

Commercial Litigation

  • Real Estate and Finance Fund (in Liq) & Anor v Sun Cheuk Pak Alan & Ors HCA 938/2022 – Acting for the liquidators of a Cayman Islands investment fund in investigating and bringing proceedings in Hong Kong in respect of apparent fraud by the former management of the fund. The proceedings involve an extensive asset tracing exercise to recover the proceeds of the fraud
  • Acted for the liquidators of a Cayman Islands investment fund in applying for recognition by and assistance from the Hong Kong Court
  • Advising high profile corporations in relation to administrative law issues
  • Acting in defence for an international law firm in a professional negligence claim of over US$300 million
  • Acting for provisional liquidators of a listed company against its former auditors in a professional negligence claim of over US$800 million
  • Acting for insurers in defending professional negligence claims against solicitors’ firms in Hong Kong
  • Advising shareholders and investors in joint venture and shareholder disputes
  • Advising on general contractual matters

Accounting Regulatory

  • Chiang Sham Lam Anthony and Anthony S L Chiang & Co. (a firm) v The Accounting and Financial Reporting Council – Acted for the Accounting and Financial Reporting Council in a review hearing before the Accounting and Financial Reporting Review Tribunal
  • Registrar of Hong Kong Institute of Certified Public Accountants v KPMG & Others D-16-1206F – Acting for the Institute in disciplinary proceedings against KPMG and two of its partners for audit failures in connection with China Forestry Holdings Company Limited, a listed company which collapsed after the discovery of widespread fraud
  • Registrar of Hong Kong Institute of Certified Public Accountants v Lin Ching Yee Daniel & Another D-18-1372F and D-18-1407F – Acting for the Institute in disciplinary proceedings against two audit partners for audit failures in connection with E.Bon Holdings Limited, a listed company. This is the first case in which the Carecraft procedure was adopted in disciplinary proceedings against accounting professionals

Competition

  • Competition Commission v Multisoft Limited, MTT Group Holdings Limited and others CTEA 1/2023 – Represented the Hong Kong Competition Commission in the first enforcement action involving cartel conduct in applications for government subsidies
  • Competition Commission v Quadient Technologies Hong Kong Limited and others CTEA 1/2021 – Represented the Hong Kong Competition Commission in the enforcement action in relation to the respondents’ agreement to fix prices, rig bids and allocate customers, resolved the disputes with consents from both parties, and obtained enforcement orders from the Competition Tribunal.

  • Estate of Li Chung (assisted in representing PwC the Administrator of the Estate of Li Chung)
  • Estate of Lim Por Yen, HCAP 4/2011 (assisted in representing the Executor of the Estate of the founder of Lai Sun Group, in a contested probate dispute)
