IP Disputes and Litigation

We act in a wide range of IP disputes ranging from trade mark, passing off, company names (shadow companies) infringement, patent and designs, copyright, trade secrets and confidential information and have achieved great results for clients in such cases, in both Hong Kong and China.

Our experience includes advising on anti-counterfeiting strategies, co-ordinating local and international investigations, and implementing enforcement programmes. We work closely with investigators, customs and other enforcement agencies to achieve practical and cost-effective results for our clients.

We have substantial experience successfully pursuing interlocutory applications for injunctions, preservation of evidence (including Norwich Pharmacal applications) and search and seizure (Anton Piller) orders. Our China related work typically involves counselling clients on IP protection and enforcement strategies, including investigations into infringers and raid actions against retailers and factories, registration of IP rights before the relevant registries, and securing Customs protection thereafter. We have had notable successes for household brands before both administrative authorities and the courts in China.

We also have extensive experience in guiding clients through potential disputes whilst avoiding litigation, providing commercial and practical insights as necessary to secure a positive end result.
